Welcome to AI Mart!

These Terms of Service (“Terms”) constitute a legally binding agreement between you and AI Mart (Private) Limited, a company operating under the laws of Sri Lanka, together with its affiliates (“AI Mart”, “we”, “us”, or “our”), governing your access to and use of the AI Mart website, platform, applications, tools, and services available at www.aimart.lk(collectively, the “Service”).

In these Terms, “you” refers to both you as an individual user and, where applicable, the entity you represent. By accessing or using AI Mart, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

1. Nature of the Platform

AI Mart is a digital marketplace and platform that enables users to discover, access, and interact with artificial intelligence tools, applications, bots, agents, APIs, and services powered by third-party artificial intelligence models, including large language models and other machine-learning systems (collectively, “AI Models”).

AI Mart may also allow developers, creators, or businesses to publish, list, or integrate their own AI-powered tools or services on the platform (“Third-Party AI Services”). Each AI service or tool is identified with relevant descriptions and attribution to its creator or provider.

AI Mart does not develop, control, or guarantee the outputs, accuracy, availability, or suitability of Third-Party AI Services and acts solely as a platform facilitating access.

2. Eligibility and Age Requirements

You must be at least 13 years of age to use AI Mart. If you are under the age of 18, you represent that you have obtained consent from a parent or legal guardian, who agrees to be bound by these Terms on your behalf and is responsible for your use of the Service.

You also represent that:

  • You have the legal capacity to enter into these Terms; and
  • If you are using AI Mart on behalf of an organization, you have authority to bind that organization to these Terms.

Some AI services available on AI Mart may generate content that is not suitable for minors, and parental discretion is advised.

3. Use of AI Mart

3.1 License to Use

Subject to your compliance with these Terms, AI Mart grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for lawful purposes.

3.2 User Acknowledgements

You acknowledge and agree that:

  • AI-generated outputs may be inaccurate, incomplete, outdated, or misleading and should not be relied upon as professional, legal, medical, financial, or emergency advice.
  • AI services may claim to perform actions but may only generate responses without executing real-world actions.
  • AI Mart provides the Service “as is” and “as available”, without warranties of any kind.
  • Use of the Service may result in unexpected results, data loss, or service interruptions.
  • Features, limits, pricing, or availability of services may change at any time without notice.
  • Certain services may be subject to usage limits, credits, points, or quotas, which have no monetary value, are non-transferable, and may expire upon account termination.

3.3 Prohibited Uses

You agree not to use AI Mart to:

  • Violate any applicable laws or regulations of Sri Lanka or any other jurisdiction;
  • Infringe intellectual property or other legal rights of others;
  • Reverse engineer, decompile, or attempt to extract source code, models, or system logic;
  • Introduce malware, abuse systems, bypass safeguards, or disrupt platform operations;
  • Scrape, harvest, or extract data except as expressly permitted;
  • Use automated systems to exceed platform limits;
  • Develop competing AI platforms or models using AI Mart outputs;
  • Misrepresent AI-generated content as human-generated; or
  • Engage in fraudulent, deceptive, or harmful activities.

4. User Content and AI Outputs

4.1 Your Content

“Your Content” includes any inputs, prompts, uploads, configurations, shared outputs, or materials you submit to AI Mart, as well as AI-generated outputs you receive.

Similar or identical outputs may be generated for other users and are not considered your exclusive content.

4.2 User-Created AI Tools

If you create, list, or integrate AI tools or services on AI Mart, you are solely responsible for:

  • Their legality, accuracy, and compliance;
  • Any content generated by such tools; and
  • Compliance with applicable third-party AI provider policies.

AI Mart may remove or restrict such tools at its sole discretion.

4.3 Ownership

You retain ownership of Your Content, subject to the licenses granted under these Terms.

4.4 Responsibility

You are solely responsible for:

  • Your use of AI Mart;
  • Verifying outputs before reliance or publication; and
  • Ensuring compliance with laws, regulations, and ethical standards.

AI Mart does not create AI-generated outputs and is not responsible for their consequences.

4.5 License to AI Mart

By using the Service, you grant AI Mart a worldwide, non-exclusive, royalty-free, perpetual, and transferable licenseto use, store, process, display, and analyze Your Content for purposes including:

  • Operating and improving the platform;
  • Providing AI-generated responses;
  • Enabling sharing where selected by you;
  • Platform analytics, security, and compliance; and
  • Legal and regulatory obligations.

5. Termination

You may stop using AI Mart at any time by deleting your account. AI Mart may suspend or terminate your access, with or without notice, if:

  • You breach these Terms or applicable policies;
  • Required by law or regulation;
  • Your use poses legal, security, or reputational risk; or
  • Your account remains inactive for an extended period.

Certain provisions, including disclaimers, liability limitations, content licenses, and governing law, will survive termination.

6. Privacy

Your use of AI Mart is also governed by our Privacy Policy, which explains how we collect, use, and protect personal data in accordance with applicable Sri Lankan data protection laws.

7. Disclaimers and Limitation of Liability

To the maximum extent permitted by law:

  • AI Mart disclaims all warranties, express or implied.
  • We do not guarantee uninterrupted, error-free, or secure operation.
  • AI Mart is not liable for indirect, incidental, consequential, or special damages.
  • Our total aggregate liability to you shall not exceed the amount, if any, paid by you to AI Mart in the preceding twelve (12) months giving rise to the claim.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Sri Lanka, without regard to conflict-of-law principles. Any disputes not resolved amicably shall be subject to the exclusive jurisdiction of the courts of Colombo, Sri Lanka.
